Terms and Conditions of Use
Please read these terms carefully before using MyHERD services.
Preamble
The MyHERD website or ''قطيعي'' (hereinafter referred to as "the Site") is an online platform for managing dairy farm reproduction, developed and operated jointly by the General Directorate for Scientific Research and Technological Development (DGRDST) and the National Interprofessional Office of Milk (ONIL) (hereinafter referred to as "the Parties") within the framework of a research project (PNR). These Terms and Conditions of Use (hereinafter referred to as "the Conditions") govern the access and use of the Site by any natural or legal person (hereinafter referred to as "the User").
1. Acceptance of Conditions
Access and use of the Site imply full and complete acceptance of these Conditions by the User. By checking the box "I have read and agree to the Terms and Conditions" or by using the Site, the User acknowledges having read and accepted the Conditions without reservation.
2. Description of Services
MyHERD offers dairy farmers and inseminating veterinarians a set of services aimed at facilitating the management of farm reproduction, including:
For Breeders:
- Entry and management of reproduction data (heats, inseminations, gestations, calvings, etc.)
- Monitoring of herd reproduction performance (indicators, reports, statistics)
- Management of treatments and veterinary interventions
- Communication with veterinarians (appointment requests, message exchanges)
For Veterinarians:
- Management of contact information and qualifications
- Appointment scheduling with breeders
- Recording of veterinary acts (inseminations, examinations, treatments)
- Consultation of reproduction data of monitored farms
3. User Account Creation and Management
To access MyHERD services, the User must create an account by providing the required information (name, first name, email address, phone number, etc.). The User is responsible for the accuracy and updating of the provided information. The User is solely responsible for the confidentiality of their account credentials (username and password) and all activities that occur under their account. The Parties reserve the right to suspend or delete an account in case of violation of these Conditions or for any other reason deemed legitimate.
4. Use of the Site
The User undertakes to use the Site in accordance with these Conditions, applicable laws and regulations, and Internet best practices. The User is notably prohibited from:
- Using the Site for illegal purposes or contrary to applicable regulations.
- Compromising the security of the Site (hacking attempts, introduction of viruses).
- Violating the intellectual property rights of the Parties or third parties.
- Distributing defamatory, abusive, or discriminatory content.
- Spamming or sending unsolicited messages.
5. User Content
The User is solely responsible for the content they publish on the Site (data, text, images, etc.). They guarantee that this content is accurate, complete, lawful, and does not violate the rights of third parties. The Parties reserve the right to delete any content that does not comply with these Conditions or that would damage the image or interests of the Parties or third parties.
6. Personal Data Protection
The Parties are committed to protecting Users' personal data in accordance with the legislation in force in Algeria. The terms of collection, processing, and protection of personal data are detailed in the Site's Privacy Policy, which is accessible at the following address: Link to Privacy Policy.
7. Intellectual Property
All elements of the Site (texts, images, logos, brands, etc.) are the exclusive property of the Parties or their partners. Any reproduction or representation, even partial, of the Site or its elements is prohibited without the prior written authorization of the Parties.
8. Liability
The Parties strive to ensure the availability and proper functioning of the Site. However, they cannot be held liable for service interruptions, errors, or omissions that may occur. The Parties are not liable for direct or indirect damages that may result from the use of the Site or the inability to use it, regardless of the cause.
9. Changes to Conditions
The Parties reserve the right to modify these Conditions at any time. Users will be informed of modifications via a notification on the Site or by email. Continued use of the Site after the publication of modifications constitutes acceptance thereof.
10. Applicable Law and Dispute Resolution
These Conditions are governed by Algerian law. Any dispute relating to the interpretation or execution of these Conditions will be subject to the exclusive jurisdiction of Algerian courts.
